Overview

Anastasia is an associate in the Planning and Compulsory Purchase team and previously trained in local government and worked for a number of London boroughs.

Anastasia has particular experience in advising on a variety of CPOs particularly in relation to local government regeneration projects in London as well as experience in CPO compensation claims in the Upper Tribunal (Lands Chamber). She is a member of the Compulsory Purchase Association, as well as a member of a number of the organisation’s working groups and has participated in training and panels on CPO topics.

More widely, Anastasia also advises landowners, developers and government bodies on a range of planning issues including planning and highways agreements, planning permissions and call-in applications and hearings. She has also significant experience in local government real estate matters and associated matters relating to large-scale housing regeneration projects.

Anastasia also has experience in conducting due diligence for a range of clients and promoting nationally significant infrastructure projects in the highways and renewable energy sectors from initial advice through to examination and liaison with multiple statutory undertakers in relation to protective provisions.

Experience

In relation to three large London Housing Regeneration Schemes, Anastasia has experience of :

  • drafting, implementation and service of multiple General Vesting Declarations (GVDs) to implement Compulsory Purchase Order (CPO) powers;
  • voluntary acquisition of commercial and residential land interests on behalf of the Local Authority;
  • multiple aspects of the Compensation Code particularly in relational to residential, commercial and community enterprise compensation claims as well as drafting the requisite undertakings to settle such claims; drafting interim leases and meanwhile arrangements post vesting of a GVD;
  • LTA 1954 advice, land acquisition and preparatory due diligence via reports on title and search interpretation;
  • undertaking an acquisition of a £2,740,000.00 residential block and leaseback to a Registered Provider in the shadow of a CPO;
  • interpretation and implementation of Development Agreements in relation to CPO;
  • CPO compensation disputes, ADR, negotiation and references to the Upper Tribunal (Lands Chamber);
  • obtaining vacant possession of interests belonging to both minor interests and ex-leaseholders via possession eviction proceedings and enforcement action via warrant accordingly;
  • rationalising multiple titles within multiple GVD red line boundaries and extensive dealings with the Land Registry in relation to the same; advice, drafting and preparing SDLT submissions and dealings with HMRC in relation to local government reliefs;
  • changes to CPO procedure and advice in light of Covid-19;
  • experience of pre ballot consultation and authoring a report on title preparing for CPO;
  • advising a Local Authority on governance issues, drafting legal implications on key decision reports in line with a Local Authority’s constitution and interpretation of Cabinet reports;
  • instructing Counsel and external legal advice and implementing such advice in relation to CPO and housing law matters;
  • reporting on risks and updating and advising a Local Authority’s Assurance board and Monitoring Officer.

Anastasia additionally has experience of (for clients in both England and Wales):

  • Acting for a wide client base ranging from individual developers to local government departments;
  • Assistance with work in to relation to the life cycle of nationally significant infrastructure projects for both the applicant and objector(s);
  • Day-to day planning advice, and on a variety of topics and agreements;
  • The life cycle of a high profile called in planning application from call in to inquiry;
  • Further all-encompassing CPO work for a number of non-London boroughs; and
  • High value CPO references at the Upper Tribunal (Lands Chamber).
